Steven Ginsburg

Steven D. Ginsburg is a partner in the Firm’s Commercial Litigation Department. Mr. Ginsburg was ranked among Top Lawyers in South Florida in 2005, 2006, 2007, 2008, 2009 by the South Florida Legal Guide, and he was named as a “Super Lawyer” in the Super Lawyers magazine – Florida edition, 2006 and 2007.  He is co-author of the Discovery Chapter, in The Florida Bar's Civil Practice Before Trial, 2004 and 2006. He is an AV-rated attorney by Martindale-Hubbell Lawyers Directory

 

Mr. Ginsburg served under Janet Reno as Assistant State Attorney, Insurance Fraud Division Chief (1976-1980) where he specialized in white collar criminal law; and as a Special Assistant Attorney General.  As Insurance Fraud Division Chief, Mr. Ginsburg investigated and prosecuted doctors, lawyers and insurance agents, among other professionals, for complex fraudulent schemes. Mr. Ginsburg’s litigation experience includes prosecution and defense of corporate and commercial matters, agreements governed by the Uniform Commercial Code, real estate, construction and banking litigation, insurance matters, anti-trust, contractual disputes, probate and other civil tort litigation.   During his tenure as chief trial lawyer and municipal prosecutor for the City of Miami Beach, Mr. Ginsburg was responsible for eminent domain, zoning, code enforcement and other municipal litigation matters. Mr. Ginsburg has extensive appellate experience, and obtained notable success in cases of first impression in Florida involving the right of a surviving spouse to retain his or her interest in an inter vivos trust notwithstanding the exercise of an elective share in the estate in Bravo v. Sauter, 727 So. 2d 1103 (Fla. 4th DCA 1999), notification to known creditors of estates in Public Health Trust v. Estate of Jara, 526 So. 2nd 745 (Fla. 3d DCA 1988), and the use of inculpatory statements in Ballard v. State, 323 So. 2d 297 (Fla. 3d DCA 1975) and Von Horn v. State, 334 So. 2d 43 (Fla. 3d DCA 1976).  For twenty years, Mr. Ginsburg served as Municipal Prosecutor for the Town of Surfside, responsible for building and zoning code enforcement prosecutions, and municipal litigation.

 

Mr. Ginsburg received his Bachelor of Business Administration in Accounting in 1973 from the University of Miami where he graduated cum laude on the President’s Honor Roll. He received his Juris Doctor degree from the University of Miami School of Law in 1976. He is admitted to the Florida Bar, the New York Bar, and the Georgia  Bar. Mr. Ginsburg is admitted to the United States Supreme Court since 1981, and is a member of the U.S. District Court, Southern, Northern and Middle Districts of Florida, U.S. District Court, Northern and Middle Districts of Georgia, U.S. District Court, Southern and Eastern Districts of New York, U.S. Court of Appeals, Fifth and Eleventh Circuits, and U.S. Tax Court. Mr. Ginsburg is a member of the American Bar Association. He was formerly the Chairman of the Florida Bar Unlicensed Practice of Law Committee. He is licensed as a real estate broker, general contractor, and roofing contractor.
