Mr. Beck has handled a variety of disputes in a number of jurisdictions including California, Arizona, Washington, Colorado, Kansas, Texas, Illinois, Florida, Virginia and New York. Mr. Beck has tried disputes that involved delegated health care contracts, hospital billing practices, attorney malpractice, employment claims, premises liability, partnership dissolution, accountant liability, and construction defect and completion. Almost all of these disputes included the presentation of complex financial, accounting and damages issues and a number involved the presentation of complex and difficult technology issues.
Mr. Beck regularly handles "short-notice" trials–– cases where trial or arbitration is scheduled to commence within sixty to one hundred and twenty days. The disputes have involved a broad range of subjects including delegated health care contracts, hospital billing practices, constitutional gaming issues, partnership disputes, accounting and valuation of an apparel business, design and implementation of a fast-food point-of-sale system, and commercial lease disputes. These matters often are "long cause" trials or arbitrations lasting more than six weeks.
During his twenty year career, Mr. Beck has litigated matters for a broad range of businesses and matters involving a broad range of issues. Following is a summary of the types of businesses and subject matters that Mr. Beck's cases have involved.
Partnership Disputes. Mr. Beck has regularly litigated and tried partnership disputes. These have included physician practice groups, law firm dissolutions and receiverships, accounting firms, ownership and valuation of a high-end denim jeans partnership now worth almost $1 billion, a number of real estate partnerships, a WIC distribution center partnership, and a hair product and salon partnership.
Intellectual Property Disputes. Mr. Beck has handled a number of intellectual property disputes including trade secret, enforceability of non-compete agreements, protection of customer lists, copyright issues, and patent enforceability.
Construction and Commercial Lease Disputes. Mr. Beck's construction litigation and commercial lease experience is extensive. He has handled a design defect international arbitration involving the design of the causeway bridge to the new Hong Kong International Airport. He also handled a dispute over the design and construction of the HVAC system for a Level 1 trauma center and the fire, life, and safety retrofit of two high rise buildings in downtown Los Angeles with over 1,500,000 square feet of commercial space. He has worked on a large number of commercial lease disputes, parking access disputes for a 1,000,000 square foot commercial development, broker fees on a $175,000,000 sale of two commercial high rise buildings, a dispute over the design and construction of dual pane windows, and the design, construction, and operation of a $100 million theme park attraction.
Health Care. Prior to opening his own firm, Mr. Beck headed Winston & Strawn's West Coast Health Care Practice Group. Mr. Beck has represented academic hospitals, community hospitals, specialty pharmacies and physician groups in litigation and regulatory matters. He has handled disputes involving hospital management contracts, hospital services contracts, Medi-Cal, Medicaid, Medicare, delegated health care services contracts, Limited Knox Keene license issues, Department of Managed Health Care audits, reviews and audits of capitation payments, hospital billing practices, compliance with federal and state law, physician joint venture agreements, physician non-compete agreements, physician capitation, and early termination of delegated health care contracts. Mr. Beck has tried a number of health care disputes to verdict and award.
Class Actions. Mr. Beck has handled a number of class-action defenses during his 20 year career. These have included matters involving the syndication of domestic oil and natural gas recovery partnerships, health care software contracts, bank dissolutions, student loan backed securities, and medical records cases. He has been responsible for opposing class certification, class discovery, merits discovery, settlement negotiations, approval of class settlements and trial preparation.
Bankruptcy Adversarial Proceedings. Mr. Beck has handled a variety of bankruptcy adversarial proceedings. These have included disputes involving medical laboratory testing, delegated health care, law firm bankruptcies and dissolutions, challenging asset sales, cosmetic companies, commercial lease terminations, and computer system leases.
Technology Disputes. Mr. Beck has handled a number of technology disputes. These have included oil and natural gas recovery technology, theme park ride design, forty person six-degree-of-freedom motion simulators, water filtration and purification, wind turbine electrical generators, power grid performance, electrical and gas powered chillers, and systems integration for a new point-of-sale system for two national fast food chains.
Auditor Liability. Mr. Beck has litigated a number of auditor liability class actions on behalf of well known auditors. These have included disputes involving revenue recognition on software service contracts and software sales, valuation of accounts receivable related to Medicare payments, valuation of real-estate loans, and revenue recognition involving sales of time-share interests.
Employment. Mr. Beck has handled a number of employment matters including wrongful termination, discrimination, and hostile environment claims. He has litigated complex disputes over employment agreements and has litigated the enforceability of non-compete, non-solicitation, and trade secret obligations.
Entertainment and Media Disputes. Mr. Beck has also handled a number of entertainment and media disputes. These have involved production company contracts, copyright licensing contracts, profit and revenue sharing calculations, print and television advertising contracts, consumer product licensing, and copyright infringement.
Honors and Awards
Mr. Beck was recognized in the Super Lawyers Corporate Counsel Edition each year from 2005 to the present.
Mr. Beck is a member of the American Bar Association, the Los Angeles County Bar Association, The Association of Business Trial Lawyers and the American Health Lawyers Association. He has served on the Los Angeles County Bar's Judicial Evaluation Committee. Mr. Beck has been actively involved in the Los Angeles community serving on the board of the Los Angeles Youth Symphony and the Geffen Theatre, coaching AYSO soccer, and serving in various capacities in the Boy Scouts of America.
Mr. Beck received a B.A. in Political Science, summa cum laude, from Brigham Young University in 1985. He received a J.D. cum laude, from Brigham Young University's J. Reuben Clark Law School in 1988.
